This program allows you the legal authority and obligation to demand a drug and alcohol-free workplace. The program allows you to test at any time, however, LAC Self Insured Fund only requires a “Post-Accident Test”.

Things to do before getting started on Health & Safety Program (Mandatory)…

  1. Designate someone in your company to manage all safety related issues. This can be one person or a team however MANAGEMENT MUST BE INVOLVED.
  2. Develop a safety policy and program that is TAILORED to fit your individual needs. (These programs MUST be site specific.)
  3. Use any and all resources that are available to assist you in performing hazard analysis surveys, onsite inspections, safety training sessions, etc. (OSHA, LDOL, National Safety Council, State Extension Services, Private Consultants, etc.)
  4. Once ALL job-site hazards are identified, one can start building a safety program that meets all of the necessary functions at your locations. However, keep in mind that your safety program will change along with any changes in your operation.
  5. Upon completion of your pre-requisites, it is now time to start including your employees in this development.
  6. Get Feedback from your workers on their various job positions, this is very important to catching potential accidents before they happen.
  7. Remember, the only way that safety can work is to get EVERYONE involved.
  8. Lastly, begin the overall implementation through safety meetings with all of your employees and keep in mind barriers associated with this, such as language and reading barriers and other similar issues.

Drug & Alcohol Policy (Mandatory):

This program allows you the legal authority and obligation to demand a drug and alcohol-free workplace. The program allows you to test at any time, however, LAC Self Insured Fund only requires a “Post-Accident Test”.

Drug and Alcohol Policy applies to all employees regardless of age, sex, race, religion or creed.

  1. All employees should read your company policy.
    1. Employers should explain what the policy involves.
    2. Have the employees sign off that they understand and agree to comply with policy requirements.
  2. Drug screen results are to be kept confidential.
  3. All testing should be done consistently among employees.
  4. Post-accident drug and alcohol screens should be conducted immediately following or as soon as possible after any accident occurs.

What is a Drug and Alcohol Program?

Louisiana law encourages a drug and alcohol free workplace. Employees may lose their right to workers’ compensation benefits if they test positive post accident or refuse a drug test, if the employer has a written Drug and Alcohol Policy in place.

We provide to you FREE of charge a sample Drug and Alcohol Policy and all required forms. We pay for the post-accident drug/alcohol tests once you implement a Drug and Alcohol Policy and join our Drug/Alcohol Program.

When do I begin the Drug and Alcohol Program?

Now is the time to set up this program, before any accident. The entire program must be in place for all employees to be effective. The Policy is available for download above. Please call us if you have questions.

How do I set up the Drug and Alcohol Program?

  1. The Employer and all Employees must read and sign your Drug and Alcohol Testing Policy. Your employees must be aware that you have implemented such a program.
  2. It is imperative that the Employer and all Employees sign the Acknowledgement Form for your Drug and Alcohol Testing Policy, which you keep for your records. If used, you will have to provide the signed Acknowledgement Form for that employee.

Who is responsible for obtaining the post accident drug test? YOU!

  1. At the time of the accident, you or a supervisor should take the employee to be tested. You must specifically request a drug/alcohol test be performed, as the medical facility may not do one automatically. Know before the accident where you will go for testing.   2. Finally, let us know the test was done.
